Last updated: July 2026 | Version 1.0 (DRAFT)
DRAFT — under review, not yet in effect. This document is a working draft prepared for review by the practice and its legal adviser. It does not yet apply to your use of this website. Nothing on this page should be relied upon as the operative terms of the site until it is finalised and published.
What these terms cover: These Website Terms of Use govern your use of the CLAD AU website, including any accounts, gated content, free tools, and email subscriptions offered through it. They do not govern the engagement of architectural services. If you engage Carey Landwehr Architecture & Design to provide architectural services, that relationship is governed by our separate Terms of Service.
1. About These Terms
1.1 Who We Are
This website is operated by Carey Landwehr Architecture & Design (ABN: 61 657 080 043) ("CLAD AU", "we", "us", "our"). These Website Terms of Use ("Terms of Use") set out the terms on which you ("you", "your") may access and use this website.
1.2 Website Use Only
These Terms of Use apply to your use of the website as a visitor or registered user. They govern browsing, registering an account, accessing gated content, using our free online tools, and subscribing to our communications.
1.3 Relationship to the Terms of Service
These Terms of Use are separate from our Terms of Service. The Terms of Service govern the professional engagement of CLAD AU for architectural services and apply once you engage our services or accept a proposal or quotation. Using this website does not create a client relationship or engage us to provide architectural services. Where these Terms of Use and the Terms of Service both apply to you, the Terms of Service govern matters relating to your architectural engagement, and these Terms of Use govern your general use of the website.
2. Acceptance and Eligibility
2.1 Acceptance
By accessing or using this website, you agree to these Terms of Use. If you do not agree, please do not use the website. Registering an account requires you to affirmatively accept these Terms of Use as part of the sign-up process.
2.2 Eligibility
You must be at least 18 years of age to register an account or subscribe to our communications. By doing so, you confirm that you meet this requirement.
3. Permitted Use of the Website
3.1 Personal and Professional Reference
You may access and view the content on this website for your own personal or professional reference. You may not use the website or its content for any commercial purpose except as expressly permitted by us in writing.
3.2 Intellectual Property in Website Content
All content on this website — including text, images, drawings, designs, logos, graphics, layouts, and other materials — is owned by or licensed to CLAD AU and is protected by copyright and other intellectual property laws. Except as permitted under applicable law or these Terms of Use, you must not copy, reproduce, republish, distribute, adapt, or otherwise exploit website content without our prior written consent. This clause concerns the website's own content; the ownership and licensing of project design documentation prepared under an engagement is governed by the Terms of Service.
4. Prohibited Conduct
When using this website, you must not:
- Use the website for any unlawful purpose or in breach of any applicable law
- Attempt to gain unauthorised access to any part of the website, its servers, or any connected systems
- Interfere with, disrupt, or place an unreasonable load on the website or its infrastructure
- Introduce viruses, malware, or other harmful code
- Scrape, harvest, or systematically extract content or data from the website by automated means without our consent
- Use the website to transmit unsolicited or unauthorised advertising or other content
- Impersonate any person or misrepresent your affiliation with any person or entity
- Infringe the intellectual property or other rights of CLAD AU or any third party
5. Website Accounts and Gated Content
5.1 Registering an Account
Some features and content require a registered account. You may hold one account for your own use. Account registration is personal to you and is not transferable.
5.2 Account Security
You are responsible for keeping your account credentials confidential and for all activity that occurs under your account. You must not share your credentials or allow another person to use your account. Please notify us promptly if you become aware of any unauthorised use of your account.
5.3 Licence to Access Gated Content
Where we make gated guides, library materials, or other resources available to registered users, we grant you a personal, non-exclusive, non-transferable licence to access and use that content for your own personal or professional reference only. You must not redistribute, resell, publish, or systematically copy gated content.
5.4 Suspension and Termination of Accounts
We may suspend or terminate your account, or withdraw access to gated content, where we reasonably consider that you have breached these Terms of Use or misused the website. You may close your account at any time by contacting us.
5.5 Account Data
Personal information associated with your account is handled in accordance with our Privacy Policy.
6. Free Tools and Interactive Features
6.1 Provided As-Is
We may make free online tools and interactive features available through this website. These tools are provided on an "as-is" and "as-available" basis for general information and convenience only. We make no warranty as to their accuracy, completeness, fitness for a particular purpose, or availability.
6.2 Not Professional Advice
Any output produced by these tools is indicative only and is not professional, architectural, engineering, or other regulated advice. It is not a substitute for engaging a qualified architect or other professional. You remain responsible for any decisions you make or actions you take in reliance on tool output.
6.3 Changes to Tools
We may modify, suspend, or discontinue any tool or interactive feature at any time without notice.
6.4 Liability for Free Tools
To the maximum extent permitted by law, we exclude liability for any loss or damage arising from your use of, or reliance on, the free tools and interactive features. This exclusion is subject to the consumer guarantees described in clause 8.
7. Electronic Communications
7.1 Consent to Receive
If you opt in to receive our newsletter or marketing communications, you consent to receiving service and marketing emails from CLAD AU. We rely on the consent you give when you subscribe.
7.2 Unsubscribing
Every marketing email we send includes a functional unsubscribe mechanism, which remains operational for at least 30 days after the message is sent. You may withdraw your consent to marketing communications at any time by using that mechanism, and we will remove your address from the relevant lists within 5 business days, as required by the Spam Act 2003 (Cth) (section 18) — or any shorter period required by law.
7.3 Service Communications
Emails that relate to an active engagement or to the operation of your account (for example, transactional or service notifications) are not marketing communications and are sent as part of providing the website and our services.
7.4 Read With the Privacy Policy
This clause should be read together with our Privacy Policy, which describes how we handle your personal information, including for marketing purposes.
8. Consumer Guarantees
Nothing in these Terms of Use excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law that cannot lawfully be excluded, restricted, or modified. Where our liability for a failure to comply with such a guarantee can be limited, our liability is limited to the maximum extent permitted by law.
9. Availability, Third-Party Links and Disclaimers
9.1 Website Availability
We aim to keep the website available and up to date, but we do not guarantee that it will be uninterrupted, error-free, or free from viruses or other harmful components. We may change, suspend, or withdraw all or part of the website at any time.
9.2 Third-Party Links
The website may contain links to third-party websites or resources. We provide these links for convenience only and do not control, endorse, or accept responsibility for third-party content or practices. Your use of any third-party website is at your own risk and subject to that party's terms.
9.3 General Disclaimer
Website content is provided for general information only. While we take care in preparing it, we do not warrant that it is complete, current, or suitable for your particular circumstances, and it should not be relied upon as professional advice. This clause is subject to the consumer guarantees described in clause 8.
10. Limitation of Liability
To the maximum extent permitted by law, and subject to the consumer guarantees described in clause 8, we exclude liability for any indirect or consequential loss, loss of profits or opportunity, or loss or damage arising from your use of, or inability to use, this website, its content, its free tools, or any third-party website linked from it.
11. Privacy
We handle personal information collected through this website in accordance with the Privacy Act 1988 (Cth), the Australian Privacy Principles, and our Privacy Policy.
12. Changes to These Terms
We may amend these Terms of Use from time to time. The current version, with its date, will always be published on this page. If we make a material change, we will give at least 30 days' notice before it takes effect — by email to registered account holders and by notice on this website — and registered users may be asked to confirm their acceptance of the updated Terms the next time they sign in. Minor changes, such as clarifications and corrections, take effect when published.
If you do not agree to a change, you may stop using the website, or close your account, at any time and at no cost. Continuing to use the website after a change takes effect indicates your acceptance of it.
13. Governing Law and Jurisdiction
These Terms of Use are governed by the laws of Victoria, Australia. You irrevocably submit to the exclusive jurisdiction of the courts of Victoria and courts of appeal from them. Nothing in this clause excludes any right you may have under applicable consumer protection law to bring proceedings in another court or tribunal of competent jurisdiction.
