# Understanding the NCC and Building Regulations
If you're starting your architectural registration journey in Victoria, the National Construction Code (NCC) will become your daily companion. Think of it as the rulebook that keeps our buildings safe, sustainable, and accessible, but it's far more flexible than you might expect.
## **Performance-based Compliance**

The NCC isn't just a prescriptive manual telling you exactly what to do. Since the 1996 Building Code reform, it's operated on a performance-based system that recognises one size doesn't fit all situations. At its heart are Performance Requirements, the fundamental outcomes every building must achieve. These broadly cover the essential categories: structural integrity, fire safety, amenity, accessibility, energy efficiency, and climate resilience.
There are two ways to meet these requirements. The Deemed-to-Satisfy (DtS) pathway gives you certainty through prescriptive solutions as outlined in the NCC itself, follow these specific rules and you're compliant. However when your design needs something different or not explicitly described as DtS in the NCC, Performance Solutions let you prove compliance through engineering analysis and alternative approaches. Most projects use a combination of both in order to pass certification.
## **What's Changed in 2024-2025**

Three major shifts are reshaping practice right now. First, **NCC 2022 Amendment 1** became fully operational in Victoria on 1 May 2024, introducing the biggest sustainability changes we've seen. The 7-star NatHERS requirement represents a 40% improvement over the old 6-star standard, that's substantial. Every new home now needs Livable Housing Design features too, making accessibility mainstream rather than exceptional.
Second, climate adaptation has moved from 'nice to have' to essential. You're no longer designing for historical weather patterns but for projected future conditions. This means considering elevated temperatures, increased flood risks, and more intense storms in your site analysis. Performance Solutions increasingly demonstrate resilience beyond minimum standards, clients and councils expect it.
Third, the Victorian Building Authority transforms into the **Building and Plumbing Commission** on 1 July 2025. This isn't just a rebrand; it's a fundamental restructure aimed at better consumer protection and industry oversight. While ARBV still handles architect registration, you'll interact with the BPC for building compliance, and they'll have enhanced powers including post-occupancy rectification orders.
These changes are significant for the National Construction Code, which is notorious for the length of time between consultation, implementation and enforcement. Remember each state has the power to 'amend' the NCC, for example in Victoria there are more strigent controls around Bushfire fire design as a result of the Black Saturday bushfires in 2009.
## **Navigating the Framework**
Understanding the NCC's hierarchy helps you make design decisions efficiently. Performance Requirements sit at the top, these are your non-negotiables. Below them, you'll choose between DtS provisions (the safe, prescribed route) or Performance Solutions (the flexible, documented route).
Here's a practical tip: early in your career, lean on DtS solutions while you build confidence. They're predictable and reduce documentation burden. As you gain experience, Performance Solutions become powerful tools for solving complex design challenges and enabling more creative designs. Just remember, they require thorough documentation and often specialist consultant input, and this can often mean additional costs.
The shift to performance-based design reflects a mature industry truth: innovation and safety can coexist when we focus on outcomes rather than rigid rules. Your role as an emerging architect is to understand both the intent behind requirements and the various pathways to achieve them.
